Agreement & Terms and Conditions

1. About Us

The MUNBYN Small Business Program (hereinafter referred to as the “Program”) is an initiative operated by MUNBYN and its affiliated entities (collectively referred to as “MUNBYN,” “we,” “us,” or “our”).

The Program is designed to support small business owners, founders, and creators by providing tools, resources, recognition opportunities, and monthly awards. The Program may be hosted on MUNBYN’s official website, landing pages, social media platforms, and related digital channels (collectively, the “Platform”).

In this Agreement, “you,” “participant,” or “user” refers to any individual who applies for, participates in, or accesses the Program.

2. Purpose of This Agreement

This Program Agreement, together with any additional policies published by MUNBYN (collectively, this “Agreement”), governs your participation in the Program.

This Agreement explains:

How the Program operates
Eligibility and participation requirements
Award selection and distribution
Intellectual property rights
Content usage rights
Liability limitations
Dispute resolution

By applying for or participating in the Program, you enter into a legally binding agreement with MUNBYN and agree to be bound by this Agreement.

If you do not agree, you must not participate.

3. Eligibility

3.1 Age Requirement

You must be at least 18 years old or the legal age of majority in your jurisdiction to participate.

3.2 Business Requirement

Participants must operate or actively build a legitimate small business, brand, or entrepreneurial project.

3.3 Original Content

All submissions must be:

Original works created by you; or
Fully authorized by the rightful owner

You must have all necessary rights to any materials, including photos, videos, logos, packaging designs, music, and trademarks.

3.4 Eligible Regions

The Program is open to participants located in the following regions:

United States
Canada
United Kingdom
Australia
Member countries of the European Union (EU)

3.5 Disqualification

You may be disqualified if:

Your submission is plagiarized
You provide false information
You violate applicable laws
You infringe intellectual property rights
You submit defamatory, harmful, obscene, or illegal content
You engage in fraud, manipulation, or abuse of the Program

Participants must reside in, or operate their business from, one of the eligible regions listed above. MUNBYN reserves the right to verify the participant’s location and business operations for eligibility purposes.

MUNBYN reserves sole discretion in determining eligibility.

4. Program Structure & Awards

The total estimated value of benefits, resources, and promotional opportunities available through the Program may reach up to $100,000 (the “Total Program Value”).

The Total Program Value is an aggregated estimate across all Program tiers (including A Tier, B Tier, and C Tier) and includes both physical products, digital resources, and non-cash promotional exposure. The Total Program Value:

Does not represent a guaranteed cash prize
Is not awarded to any single participant
May vary based on participation, availability, and selection outcomes
Is distributed across multiple participants over time

No participant is entitled to receive any specific portion of the Total Program Value.

The Program includes three tiers:

Each selected founder receives:

Best-selling MUNBYN thermal printer
4×6 shipping labels
Creative brand stickers (logo & color set)
Barcode labels for inventory
Gradient designer labels for standout packaging

Selection Details:

5 founders selected every month
Winners are selected through a random drawing process
Drawing takes place on the first Wednesday of each month
Winners will be notified via email or official MUNBYN communication channels

Additional Conditions:

Prizes are non-transferable
No cash substitutions
MUNBYN reserves the right to substitute items of equal or greater value
Winners must provide accurate shipping information

Failure to respond within 7 days of notification may result in forfeiture.

4.2 B Tier: Starter Boost Pack

Instant tools. Instant upgrades. Zero cost.

Participants may receive:

Label starter access (products & resources)
Free guides and templates including:

2,000+ essential label templates
Small brand packaging upgrade guide
Shipping label sizes & platform requirements guide

Distribution may occur automatically or at MUNBYN’s discretion.

Digital materials are provided “as-is.”

4.3 C Tier: Creator Spotlight

Get seen. Get featured. Get celebrated.

Participants may be featured by showcasing:

Workspace with your MUNBYN printer
Custom brand packaging
Creative shipping label designs
Inventory & barcode setups

5. Use of the Program

You agree:

To use the Program for lawful purposes only
Not to exploit the Program for resale or commercial redistribution of prizes
Not to engage in automated scraping, spam, impersonation, or fraudulent activity
Not to damage or interfere with MUNBYN systems

You may not:

Reverse engineer any MUNBYN software
Remove proprietary notices
Misuse trademarks
Spread spam or unauthorized advertising

MUNBYN may monitor participation to ensure compliance.

6. Privacy & Personal Information

You agree to provide accurate information including:

Full name
Email address
Shipping address
Business information

Your information will be used for:

Identity verification
Prize fulfillment
Program administration
Marketing use where permitted

If prize delivery fails due to inaccurate information, the prize may be forfeited.

7. Intellectual Property & License

7.1 Ownership

You retain ownership of your submitted content.

7.2 License Grant

By submitting content, you grant MUNBYN a:

Worldwide
Perpetual
Royalty-free
Non-exclusive
Transferable and sublicensable

license to use, reproduce, edit, adapt, publish, distribute, display, and promote your content for marketing and promotional purposes, both commercial and non-commercial.

This includes use across:

Social media
Print materials
Advertising
Product packaging
Exhibitions
Retail displays

No additional compensation shall be required.

7.3 Third-Party Rights

You represent that:

All identifiable individuals in submissions have provided consent
No rights of publicity or privacy are violated
Your participation does not breach third-party agreements

8. MUNBYN Intellectual Property

All trademarks, logos, designs, content, and materials provided by MUNBYN remain the exclusive property of MUNBYN.

Participation does not grant ownership rights.

9. Monitoring & Enforcement

MUNBYN may:

Review submissions
Remove content
Disqualify participants
Suspend access

without prior notice if violations occur.

10. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

The Program is provided “as-is” and “as-available.”
MUNBYN makes no guarantees of selection or award.
Participation is voluntary and at your own risk.
MUNBYN is not liable for indirect, incidental, special, or consequential damages.

MUNBYN’s maximum liability shall not exceed the retail value of the prize awarded to you.

Some jurisdictions may not allow certain limitations; applicable consumer rights remain unaffected.

11. Termination

MUNBYN may suspend or terminate your participation:

If you violate this Agreement
If fraud or misconduct is detected
If required by law

Certain provisions survive termination, including Intellectual Property and Liability clauses.

12. Modifications

MUNBYN reserves the right to modify, suspend, or discontinue the Program or these Terms at any time.

Continued participation constitutes acceptance of changes.

13. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws applicable to MUNBYN’s principal place of business.

Any dispute shall first be resolved through negotiation. If unresolved, disputes may be submitted to arbitration or competent courts as permitted by applicable law.

14. General Provisions

Nothing creates a partnership or agency relationship.
If any clause is invalid, remaining clauses remain effective.
MUNBYN may assign rights under this Agreement.
